The perils of loaning :o(

Postby xxkatejayxx on Mon Nov 05, 2007 5:09 pm

Well I know longer have H on loan, his owner went up the yard last night and collected him - straight out of the field before I even got there   She didn't even tell me, one of my mates at the yard told me and said that his owner had said not to say anything. Apparently one of the liverys rang her and then she turned up with the box to pick him up! She text me later on on the night to say that she'd been told other people were doing him more than me which wasn't true at all - I was down there at least 5 days out of 7 and on the 2 days I couldn't get down someone else fed him for me, he was allowed to be left out at night - again not true, she said was I going to leave him in at night or out and I said probably out for a bit longer until it gets really cold and I told her last week that he would be coming in from this thursday which she said was fine. Also apparently I handled him in appropriately at times and he was picking up habits

I know who rang her and this person has been kicked off another yard before for stirring things up, shes old enough to know better aswell (shes in her 40s I'd say), she told me the other day she though H was underweight (he doesn't look it at all - her horse weighs 680kg and is a 15.2 cob x!) and shes not even down in the week after work - I go down every night (or at least 3) after work so get there about half 5, then I'm there all day Saturday and Sunday unless I go to my mom and dads for dinner - shes there at half 6 each morning, after 2pm on a Saturday and a few hours on a Sunday!

I can't believe she just came and took him without letting me know, I even text her to ask if she was still ok for sunday as she was coming up to help me with the school and she text back saying 'I'm fine, hows Hugo? Now this was 2 hours after she had picked him up!!!

We signed a loan agreement and it said that we had to give each other 30 days notice if either I didn't want him anymore or if she wanted him back unless he was been neglected - which I don't think he was.

She also got someone to let her into my barn (which was padlocked - my best mate has the spare key and had left it in her stable so someone must have gone and got it as she wasn't there then) and she took 3 bales of shavings (as she said thats what she give me when he came but she said I could have them), her saddle and 2 of MY rugs. She said she took the rugs as she couldn't find his bridle but she knew that I'd took it home to clean it as I told her that when she came down to see him and ride him on Monday!! She said I can have my rugs back when she gets her bridle back and that I was to drop it down the yard by the weekend, then she would return the rugs!!

She came down Monday night after shed finished work (she finished at half 3 so I used time that I'd got owed to me so I could leave early to get down in time for her to ride before it got dark) but didn't say anything to me at all.

I worked out today that since I've had him (22nd September until yesterday, 30th October) I've spent £277 on him

I really can't believe shes done this to me. I've attached  2 piccies of him, the 1st is one she took last Summer and the 2nd is a piccie of him from when I had him - do you think he looks underweight or neglected??:

well kate he looks no different to me in the pics and also she has broke the contract ,you have these contracts in place to stop this so i would get some advice ,i dont know where from tho maybe go to your local citizens advice center  ,but firstly i would either write her a letter or ring her and tell her that shes broke the contract ,that is unforgivable what she has done i would be gutted if the owners of my horse did that to me ive had him 5 years tho ,i really feel for you im sorry i hope you get things sorted x

She said that:

1) It was agreed that he would stay in at night, however she said it was upto me what I did so I told her that I was going to keep him out until the 1st November when it started to get really cold which she said was fine. He wasn't clipped, is a native breed and had a medium weight turnout with a neck on in the at night and a lightweight turnout on in the day

2) I behaved inappropriately with him on occasion. Hmm well everyone I've asked and she asked didn't agree (apart from 1). When he first arrived he used to drag you to grass when you led him past but he didn't do that when he left, I was always firm but fair with him.

3) Other people were doing him more often than me. Now I went up at least 5 days out of 7, she knew that I couldn't get up every day on on those two days my friend always did him for me and in return I'd do her horse for her. My dad used to take me up there each night after work (3 nights a week) and then on a weekend I would make my own way up there - often getting there at half 8 in the morning and not leaving until 5pm

Also she still has two of my rugs - the mediumweight turnout he had on when she collected him as "he had it on when she fetched him in" (so she travelled him in the box in it ) and the fleece I brought him. She got her bridle back yesterday, yet still has my rugs

OH what a shame:angry: it's not on that she didnt give you any chance to defend yourself (if she had any concerns).

Whoever is the sh1t stirrer is well out of order.

I'd arrange to return the bridle, and collect the rugs and make sure she is there in person....and have it out with her to get to the bottom of what her problem was.

He looks a lovely horse, and i think you kept him just fine.

Sorry to here that, its a real shame. Maybe it wasnt ment to be, afterall you want a nice loaner.

Although yes she broke her contract BUT did she have somthing written down that states if she is worried about the care of the horse he could be taken back immediatly we have this.

There may not of been anything wrong, she should of looked into it more before taking him back but if I though, and im sure many others would do the same, that my horse wasnt being cared for properly I would take them back immediatly then wait 30days and find out hes really ill. Im not saying he is like this but you do have to understand the other side. Having had to bring my pony back ASAP before I know sad outcomes of it.

I hope you do find a nice horse, maybe it wasnt ment to be, I hope this experience hasnt put you off.

O how awful for you.  He looks absolutely fab in the piccies and very well looked after.  You do need to find out why she has done this though, just to establish exactly what has gone wrong.  Some people are just like that though, dont take it personally, but again try to find out what happened - sounds like someones stuck their nose in where its not wanted!.  Good Luck keep us posted. x.

Hope this helps a bit but ive had this happen to me , i was loaning a horse from someone we had a loan agreement and everything then 6wks  later she came and got him out of the feild without me knowing or telling me , of course i went down that day and thought he had been stolen!!! i was in a right state anyway when i phone her she could hardley talk to me or face me because she knew she was in the wrong , i was really upset about it  because she didnt have the guts to tell me she was moving him If she did i would have been ok with it , i was really angry that she made me think he had been stolen and i really didnt think that was fair . it turned out she found someone else  to loan him who was going to do local shows with him thats why he was move from me , but that loan didnt work out and then i saw him up for sale , it just showed to me that she was not a very nice person and i was better of without that type of owner ,

I now have my own horse and he is out on loan we have a loan contract where i have to give them a months notice and i would not dream of just going to his feild and just tacking him as i know they have spent money on him  and there time schooling and keeping him fit and so on .

Dont give up as there are some nice people out there who loan there horses out and loan them
